好大的官威！議長邱莉莉飆罵分局長「沒路用」 判拘役30日

邱莉莉辱罵分局長和偵查隊長，遭判拘役30日（圖＿截自邱莉莉臉書）。

台南市議長邱莉莉去年底因不滿遭人在網路惡意攻訐，於去年12月7日前往台南市警二分局中正派出所提告，竟當場飆罵分局長和偵查隊長三字經，還狂罵「你這次死啦！」、「沒路用」、「你們都內神通外鬼」。法官認邱莉莉犯侮辱公務員罪處拘役30日，可易科罰金。

判決指出，邱莉莉12月7日當晚10時8分許，因認在競選期間內受他人於網際網路惡意攻訐，而妨害其名譽，至台南市中正派出所欲提起告訴。進入中正派出所後，邱莉莉與局長方仰寧通話，方仰寧以電話指示第二分局長朱信憲前往協助，後來朱信憲與偵查局長林逸新一同前往派出所。

不料，邱莉莉見朱、林抵達中正派出所後，態度突然失控，對2人咆哮「你們都沒路用」、「你保護我什麼？你保護罪人啦！」「幹X娘」、「你們都內神通外鬼」等語。過程中，邱還屢次拍桌及對茶几摔擲手機等，態度囂張。

事件發生後，國民黨議員在臨時會期間爆料指她到派出所咆哮，並要求公布監視錄影帶畫面。議員蔡淑惠要求保存畫面並依妨害公務送辦，警方表示「保持行政中立，不捲入政治紛爭」，令多名議員不滿，並要求把方仰寧趕出議事廳。時任議長郭信良最後裁示，警方要把案件移送台南地檢署偵辦。

台南地院指出，邱莉莉對依法執行公務的朱、林表示「你們都沒路用」、「你娘」等語，且伴隨多次拍桌、摔擲手機於派出所內茶几等行為，屬非理性且具侮辱、輕蔑舉動，足令2人感到難堪與屈辱，貶損其人格尊嚴，動搖人民對國家公權力行使之可靠性與可信性。法院認邱莉莉言行逾越言論自由保障範圍，因此依《刑法》侮辱公務員罪，判處邱莉莉拘役30日，得易科罰金。
