南市「都市計畫容積移轉」新規定111年1月22日上路

為加速取得公共設施保留地並提升都市容積移轉的實施效益,市府都發局修正「臺南市都市計畫容積移轉審查許可要點」,並經市都委會審議通過,新規定於本月22日上路,市長黃偉哲表示,新規定通過後臺南市整體都市發展向上發展可受期待。

市府都發局表示,本次修法增訂人行步道用地得為送出基地,另可作為送出基地捐贈之公共設施保留地應經市府工務局或其他道路主管機關同意取得始能作為送出基地;且為增加產業發展所需空間,增訂工業區接受基地臨接寬度達12公尺以上之計畫道路,得移入基準容積之20%;再為避免接受基地因容積移入增加建築量體,衍生交通上或救災困難等問題,增訂接受基地其檢討臨接之計畫道路,於接受基地側應闢建足寬達8公尺以上,並連通已闢建達8公尺以上之道路;另為減輕接受基地因容積移入增加建築量造成都市環境衝擊,修正接受基地面臨平均深度10公尺以上且面積0.25公頃以上之永久性空地,始得申請酌予增加移入容積;並參酌其他縣市規定,增訂移入容積之折繳代金之計算方式、評定方式及費用負擔。

市府都發局再表示,南市透過容積移轉機制辦理案件, 108年至110年合計核准96件,共取得148,312㎡之公共設施保留地,以公告現值計算約新台幣47億元,可部分紓解政府因財政困難長期無法有效解決公共設施保留地徵收問題。
