22萬名家庭看護工納保 勞工職業災害保險及保護法今天上路

勞工職業災害保險法及保險法今（5/1）上路，受雇登記有案事業單位的勞工將全數納保，此外，全台的22餘萬名家庭看護工也要全面納保，由於家庭看護工雇主多為自然人，勞保局將與勞動力發展署勾稽，逕行成立投保單位，以簡政便民，費用規劃每季繳納1次，每次約100多元。

依據勞動部資料統計，到2021年底，家庭看護移工共有22萬5423人、家庭幫佣則有1465人，這些勞工依照原先的勞保條例，並不需加入勞保，但災保法上路後全數都得加入職災保險。
勞保局表示，勞工職業災害保險及保護法今天上路，將新增20萬餘名家庭看護工納保，並與勞動力發展署勾稽資料，再寄發給20萬餘個雇主；雇主會在8月25日前收到首次繳款單，若依最新職災費率計算，家庭看護工的職業災害費率是0.18％，因此1季約繳交100餘元。
勞保局指出，由於家庭看護工與幫傭的工作型態、工作時間與休息時間與受雇事業單位勞工不同，且不易釐清，若要求雇主備置災保法所提的出勤工作紀錄或薪資帳冊，將有窒礙難行之處，因此家庭類移工雇主可以用聘雇許可函、勞動契約書及薪資明細表替代出勤工作紀錄及薪資帳冊。
勞保局表示，若雇主未繳交職災保險保費，且在寬限期間仍未繳納，每超過1天將加徵其應納費額0.2％的滯納金，加徵至應納費額20％為限。勞保局還可以就應繳保險費及滯納金，依法移送行政執行。
