員工遲到記警告擔心被解雇 公司未訂定規則遭嘉縣府開罰2萬

在嘉義縣某公司任職的小豐（化名）因工作屢次遲到被主管記警告1次，擔心因此被公司解雇向縣府提出疑問，經縣府調查該公司以工作守則懲處小豐並無不可，但該公司自今年5月20日僱用勞工人數達30餘人，卻未制定工作規則，認定仍屬違反勞動基準法規定，裁罰2萬元罰鍰。
勞工暨青年發展處表示，小豐受僱於公司，應該遵守一定規範，公司依內部規定所作懲處尚屬合法範圍，但若公司僱用勞工人數已達30人以上，則應依勞基法第70條規定，就工時、休假、工資、津貼及獎金、紀律、考勤、請假、獎懲及升遷、資遣、離職及退休、災害傷病補償及撫卹、福利措施等另訂工作規則，報請主管機關核備及公告印發各勞工，讓勞工有所依循。
勞青處進一步說明，勞動基準法僅是最低標準規定，公司內部規範制度，則需要透過工作規則訂定，讓勞動條件與紀律制度化，例如請假程序、獎懲標準、升遷方式等，藉此激勵員工，也有助於管理，避免不必要的勞資爭議。
此外，勞工工作若屢次遲到，公司不得逕以曠工扣薪或以不能勝任工作理由資遣員工，應依工作規則中所訂的懲罰標準列入紀錄，若違反規定紀錄達一定次數，則符合勞基法第12條所規定情節重大，才可資遣勞工。
勞青處長陳奕翰說，公司訂立工作規則前，可參考勞動部提供的工作規則範本，再依工作實際態樣訂定工作規則，但內容不可低於勞動基準法，如遇爭議事項，建議與勞工多多協商，避免不必要爭議，如有疑慮，可洽詢勞青處05-3620-123轉分機8028。
