停用「大陸人民亦為國民」函釋 律師：應該要修法

2018年，一名中國男子來台遭路燈電死，法院以30年前法務部函釋「大陸地區人民亦為中華民國人民」判國賠463萬元。今年二月，法院作出二審判決，維持一審判決，引發民眾討論。 昨日，行政院發函通令各部會，中國大陸人民不具中華民國國籍、非屬中華民國國民，不享有或負擔中華民國國民的權利義務。要求即日起停止適用或不再援用「大陸地區人民亦為中華民國人民」等相關函釋。
此案關鍵在於兩岸人民關係條例認為中國地區人民為中華民國人民，加上國家賠償法並未禁止中國人民請求國家賠償，所以適用台灣的國家賠償法。目前台灣以及中國人民的關係依然適用兩岸人民條例，用發函通令的方式解釋兩岸人民條例是否妥當？律師江信賢表示：「行政函釋無法解釋所有情況，建議要修改兩岸人民條例比較妥當。」江信賢強調，若要修改國家賠償法的話，也不會牴觸憲法，因為一個是民事法律，一個是說明國體的法制。
至於刑事範圍的判決，例如台灣人在中國犯罪的判刑是否會受到影響？江信賢律師表示：「這是很奇特的現象，根據兩岸人民條例，目前兩岸的關係既不是國外也不是國內。這會造成一個問題，假設你在中國犯罪被判刑的話，不能折抵在台灣的刑期，因為不是在國外。但又因為不是國內，所以會再判一次刑，造成一罪兩判的情形。」
