說好要戴卻晃點 男無套愛愛2分鐘害女友懷孕遭告 法官判賠10萬元

高雄一名女老師要求男友戴套嘿咻，但男友卻「陽奉陰違」，撕開保險套包裝虛晃一招，其實根本沒戴，無套嘿咻2分鐘後女子驚覺有異將他推開，女老師在5周後驚覺懷孕，依侵害她的性自主決定權，向男友提告求償60萬元，雖然過程並未射精，但男友坦承錯誤，被法官判賠10萬元。

判決指出，女老師和洗車工男友從2020年7月3日開始交往，交往期間，兩人多次發生「無套」性行為，同年7月16日，女老師估算自己的危險期快到了，因不想懷孕，要求男友一定要戴套，男友口頭上說好，並當著女老師的面撕開保險套，但他卻沒有套子戴上，直接無套插入，兩人嘿咻2分鐘，男友還沒射精，女老師感覺觸感不對，推開男友後，才發現他果然沒戴套。
女老師情緒激動，當場臭駡男友，男友傳訊給她道歉，說自己真的很愛她，不管女老師的決定如何，自己都會負責，女老師則不滿男友態度，反問男友：「你有沒有在想我到底有沒有懷孕的事」，男友回她：「有，但我不敢開口問，怕妳又心情不好」，女老師告訴他：「不是因為誰會不開心就不提這件事，事情發生，怎麼解決才重要，你讓我一個人在做這些事，你這樣不對」，男友則回她：「對不起，是我錯了，我不會再讓妳感覺我沒有在關心妳，對不起老婆」。

雖然男友肯負責，但女老師在5周後月事沒來，才發覺自己懷孕，她不想要小孩，也不想要人生計畫被打亂，於是決定服藥墮胎；流產後，女老師傳訊質問男友「為什麼當初我要你戴你不戴，你現在養得起我跟小孩嗎？」、「我要你戴，就是因為我知道我自己不想要有，不想要結婚，我還沒達到自己想要的目標，我還沒辦法承受我有了要生下來養，工作要怎麼處理，錢要怎麼處理」。男友則一再道歉「這是我的錯，是我興奮過頭」，女老師不接受道歉，反問：「你真的愛我真的為我想的話，你不會讓我經歷這件事」
兩人最後不歡而散，女老師認為男友在未戴保險套的情形下與她發生性行為，導致懷孕進而流產，已不法侵害她的性自主決定權，於提告求償60萬元精神慰撫金；高雄地院審理時，男友坦承錯誤，法官根據醫院報告及相關對話訊息，認定男友有責，判他應賠10萬元，可上訴。
