白天操課太累士官睡過頭「洞洞」沒上哨 判刑2個月可易科罰金

海軍陸戰隊武姓下士疑白天操課太勞累，輪值半夜站安官卻睡死在寢室內，徐姓上士巡哨時發現安官桌沒人，直接呈報上級，原本依軍法衛兵哨兵廢弛職務罪可處5年以下徒刑，法官認為武男的確未執行衛哨勤務，但營區卻未因此遭到損害，最後判刑2個月，得易科罰金。

判決指出，在海軍陸戰隊陸戰九九旅擔任志願役下士的武姓男子，疑似白天操練太過勞累，去年7月11日凌晨0點，他被安排要值勤安全士官職務，巡查連隊官士兵就寢狀況，但他卻沒有準時上哨，直到54分鐘後，才被徐姓上士巡哨時，發現武男仍在寢室睡覺。
徐姓上士直接呈報上級，武男被依違反衛兵哨兵廢弛職務罪送辦，根據《陸海空軍刑法》規定，衛兵、哨兵或其他擔任警戒職務之人，因睡眠、酒醉或其他相類之情形，而廢弛職務，足以生軍事上之不利益者，處5年以下有期徒刑。
高雄地院審理時，武男坦承犯行，法官見他犯後態度良好，雖然執勤時睡覺，無法警戒四周避免侵入，顯已廢弛職務，但實際上軍區並沒有遭人入侵，因此判他徒刑2月，得易科罰金，可上訴。
